General Information

Bipunkt.se is operated by Gedomaksis, MB, Veiverių g. 9B-62, LT-11346 Vilnius (hereinafter referred to as Bipunkt.se). These Rules for participation on the website at www.bipunkt.se set out the conditions for placing advertisements on the website at www.bipunkt.se and their review, as well as the rights, duties and responsibilities of Bipunkt.se participants. The Rules are binding on all participants in Bipunkt.se. The participant expresses his/her consent to the Bipunkt.se Rules and the obligation to comply with the Rules in any way and form by using the website www.bipunkt.se. Persons who disagree with at least one condition of the Rules are not entitled to become participants in Bipunkt.se. The operations of Bipunkt.se are the provision of technical means for placing and viewing advertisements on the Internet. In Bipunkt.se, a participant is a person who has placed or wishes to view an advertisement on the website.

Advertisement Content and Form

• It is forbidden to place advertisements about anti-radar devices, donations of human internal organs, blood, semen, etc.; medicines, food supplements; medical, sobering, detoxification services provided at the patient’s home; fuel, vehicle documents and technical passports; petroleum products; some chemicals such as mercury; narcotic substances, alcoholic drinks, tobacco products, hookahs, electronic cigarettes and their accessories and supplies; unauthorized weapons (limited civil liability); non-refillable (single-use) fluorinated greenhouse gas containers; advertisements of a political, religious, defamatory, threatening, discriminatory, deceptive, pornographic nature, containing incitement to violence, inciting national, ethnic, racial, religious hatred.
• Bipunkt.se participants are not allowed to provide inaccurate information in the advertisement. Bipunkt.se participants must provide objective, fair, non-misleading, comprehensive and complete information about the goods offered for sale and actually available and/or the services offered and actually provided, including, but not limited to, quality, condition, characteristics, manufacturer, price. The advertisement must also provide the correct contact information: contact telephone, e-mail.
• The advertisement can be illustrated with a maximum of 20 photos, which must display only the object offered for sale, the logo of the company offering the services/works or a photo of the person looking for a job. A photo should not exceed 10Mb.
• It is forbidden to place any graphic images/letters/numbers (e.g. handwritten notes, telephone numbers, surnames, catchy words) or a combination of photographs with graphic images/letters/numbers instead of photographs of the object for sale or to alter the photographs in this way.
• By placing an advertisement, its author assumes full responsibility for the compliance of its content with the terms of the Rules.
• Advertising of other online advertising sites on Bipunkt.se is strictly prohibited. Ads will be deleted without notice, and no refunds will be given if any ads have been ordered.

Rules of Advertisement Placement and General Conduct

• The participant who placed the advertisement must have the offered object. It is forbidden to offer an object in the advertisement: if the object is already sold; if the buyer has yet to order the object from the user who placed the advertisement or the person indicated by him/her; if there is a charge for information about the object.
• Bipunkt.se is not responsible for the content of messages sent by users (internal messages or e-mail) to other visitors of the portal.
• It is forbidden to submit, publish, send or store any content on the www.bipunkt.se website for the purpose of committing a criminal offense.
• Only one advertisement for each object for sale, purchase, lease, exchange, donation, service provided (hereinafter referred to as the Object) may be placed to the Bipunkt.se database.
• The advertisement must be placed only in the category of the Bipunkt.se website allocated to it (e.g. the advertisement for the object looked for cannot be placed in the category with objects for sale).
• By placing the advertisement, the author confirms that he/she has the right to use the photographs and that such use does not violate the rights of any third parties.
• Bipunkt.se has the right to process (collect, store, process, keep, inquire, select, merge, use, hide or delete) advertisements of Bipunkt.se participants that they have entered in the Bipunkt.se database for the purpose of submitting and passing them on to third parties (Data Recipients) who use the Database to search for advertisements.
• Bipunkt.se Participant agrees that by placing his/her Advertisement, he/she does not acquire copyright to the Database, but has the right to modify, supplement or update his/her Advertisement.
• The Participant of Bipunkt.se agrees that if a reasonable user complaint is received or if the administrators of Bipunkt.se believe, or it is obvious from the Advertisement entered in the database that the Advertisement contains incorrect information or that the Advertisement contradicts the universal principles of rights, morality, decency or ethics, Bipunkt.se has the right to remove the Advertisement from the Database and/or block the Participant in Bipunkt.se.
• The Participant of Bipunkt.se agrees that Bipunkt.se is not a representative, agent or executor of the Data Recipients’ rights and is therefore not liable for any damages incurred through the Bipunkt.se system.
• By agreeing to the General Rules of Bipunkt.se, the Participant undertakes not to abuse the possibility to send and/or receive short SMS messages via the Bipunkt.se system in any possible way. When such offenses are detected, all information will be passed on to the relevant law enforcement authorities.
• Participants in Bipunkt.se must comply with all the Rules of decency and morality when providing information about the Object (not to use profanity, words or phrases that may offend others, pornographic content, sexually explicit content or content involving satisfaction of sexual desire for reward, other indecent content), also must not violate the right to privacy of any person and intellectual property rights.
• For such misconduct, Bipunkt.se participants are subject to a warning of a violation of the Rules of morality, a removal of the advertisement with the obscene content from the Bipunkt.se database, a removal of the Bipunkt.se participant from the system without the right to ever re-register.
• When placing an advertisement, the advertiser must comply with the Bipunkt.se Rules for placing an advertisement. Advertisements that do not comply with the Rules may be removed without notice, and no refunds will be given if any ads have been ordered for the advertisement.

Cookies

For the Bipunkt.se website to operate properly, it saves small data files, called cookies, on the Client’s device. Most major websites do the same. A cookie is a small text file that the Bipunkt.se website saves on the Customer’s computer or mobile device when the Customer visits it. As a result, the Bipunkt.se website may “remember” the Customer’s actions and options (such as registration name, language, font size and other display options) for a period of time, without the Customer having to re-enter them each time they visit the site or browse its various pages.

 

Copyright

Bipunkt.se is the owner of all rights to the content of the www.bipunkt.se website and the Bipunkt.se database, and has the exclusive right to use it. Any modification, processing, copying of the content of the website at www.bipunkt.se without the written permission of Bipunkt.se by third parties is a violation of copyright and leads to liability under the law of the Republic of Lithuania. This restriction does not apply to Advertisers with respect to their Ads. The Participant agrees that Bipunkt.se has the right to use the photographs and other content of the Advertisements for advertising purposes without disclosing the personal information of the Participant. Neither Bipunkt.se nor any other third party will be obliged to pay the participant royalties or other remuneration for the use of such advertisements or other content published by the participant.

 

Amendment of Terms

Bipunkt.se has the right to partially or completely amend the Rules. If you participate in Bipunkt.se after the amendments have been made, this means you accept them.

Applicable law

Bipunkt.se Services and these Terms of Use are governed by the Swedish law. Disputes must be settled at a Swedish court of general jurisdiction. You can also contact the General Complaints Board, read more at: www.arn.se.

Paid Services

General Provisions

The Services provided on the Bipunkt.se website shall be paid for via Paypal, Credit/Debit Card and Bank Transfer (Paysera). The paid services may be provided only after the User pays for them in accordance with the procedure established on the Bipunkt.se website. The User shall be deemed to have paid for the Paid Service when the Supplier actually receives the User’s payment.

Users of Bipunkt.se can order additional services for a fee: ad highlighting, ad advertising, stars, updates, etc.

The price of the Paid Services depends on the Service Plan, the Ad Category, as well as on whether the User requests additional Services.

The Supplier has the right to restrict or terminate the provision of the Services for an indefinite period of time during scheduled maintenance. In this case, the User using the Paid Services is informed about the start of scheduled maintenance by e-mail and/or other notice not later than one (1) hour before the start of works. In this case, the Supplier may, but is not obliged to, extend the provision of the Paid Services to the User for the period during which the Paid Services were not provided, or provide the Paid Services free of charge equivalent to the non-provided Paid Services (if the Paid Services are not continuous).

Fees for Advertisements that have been deleted and/or removed due to the User’s violation of the provisions of these Rules are non-refundable.

Refund

Subscription money is refunded only if the ordered services were available less than 90% of the time of the subscription period. Bipunkt.se shall not be liable if the service was unavailable due to the fault of the user’s Internet service provider or terminal equipment. The money shall also not be refunded if the user considers that the service is not relevant or of insufficient quality.

How does advertisement-starring work?

An advertisement is moved up the list using the stars, that is the more stars ordered for the advertisement, the higher it will appear on the list. If several ads have the same number of stars, the one with the longer star order will appear the higher. You can order to move your ad up the list by logging in to your ad account. The price of one star per day is 1 SEK, two stars per day will cost 2 SEK and so on.
